Welcome to Cybovolt. We want every customer to feel informed before placing an order and supported throughout ownership. These Terms of Service are designed to explain your rights and responsibilities clearly, while helping us provide a transparent, fair, and dependable customer experience.

These Terms of Service ("Terms") govern your access to and use of [www.cybovolt.com], any related Cybovolt online services, and purchases made directly through our website. Throughout these Terms, "Cybovolt," "we," "us," and "our" refer to Cybovolt LLC.

By visiting our website, creating an account, placing an order, or using our online services, you agree to these Terms and the policies referenced below. If you do not agree, please do not use our website or place an order.

These policies are incorporated into and form part of these Terms. If a product page, written promotion, or model-specific policy contains additional terms, those additional terms also apply to the relevant product or offer.

You must be at least the age of majority in your state or jurisdiction of residence to place an order. If a minor accesses the website or uses a product, a parent or legal guardian must be involved and responsible for ensuring that any use is permitted by law, appropriate for the rider, and properly supervised.

Electric dirt bikes are not toys. Certain models may be high-performance products intended only for appropriate riders and permitted riding environments.

When you place an order, create an account, submit a service request, or communicate with us, you agree to provide complete, accurate, and current information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe that your account, payment details, or personal information have been used without authorization.

We make reasonable efforts to present product descriptions, specifications, photos, estimated performance information, and availability accurately. However, product information may occasionally contain errors or require updates.

Product availability is not guaranteed until an order is accepted and processed. We may limit quantities, discontinue products, or correct errors when reasonably necessary.

Unless otherwise stated in writing:

• Photos are provided for general reference, and minor appearance differences may occur;
• Estimated range, speed, charging time, and performance may vary based on rider weight, terrain, temperature, riding mode, speed, payload, maintenance, battery condition, and other real-world factors;
• Product software, app features, packaging, and functionally comparable components may be updated over time; and
• We may use an equivalent or functionally comparable component when necessary, provided that doing so does not materially reduce the product's intended functionality.

Nothing in these Terms permits misleading product claims. If a material product-description error affects your order, please contact us so that we can review the appropriate solution.

Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, delivery fees, and other disclosed charges may be added at checkout.

Promotions, discount codes, complimentary gifts, bundles, and limited-time offers are subject to the terms displayed with the offer. Unless stated otherwise, promotions cannot be combined, redeemed for cash, or applied retroactively.

We reserve the right to correct a pricing, description, or promotional error. If an error materially affects an order, we may contact you for instructions or cancel the affected order and issue the appropriate refund.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges. Financing, installment payment, digital wallet, and third-party payment services may be subject to separate terms provided by the applicable financial service provider.

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been finally accepted.

We may reasonably verify order information before fulfillment. To help protect customers and prevent fraud, we may request additional information, limit quantities, pause processing, or cancel an order when we reasonably suspect unauthorized payment activity, identity misuse, inaccurate information, resale abuse, or other unlawful conduct.

If we cancel an order for a reason attributable to Cybovolt, we will issue the appropriate refund. Nothing in these Terms limits a customer's lawful right to dispute an unauthorized charge.

Shipping timelines, eligible delivery locations, freight procedures, and delivery conditions are described in our Shipping Policy. Estimated delivery dates may be affected by carrier schedules, weather, remote-area requirements, appointment availability, and other factors outside our reasonable control.

We will make reasonable efforts to ship orders within the timeframe stated on our website or communicated to you. If we cannot ship within the promised timeframe, or within the period required by applicable law when no timeframe was stated, we will provide notice and offer the options required by applicable law.

Please inspect the carton and product shortly after delivery. Visible shipping damage, missing items, and delivery issues should be reported in accordance with our Return & Refund Policy.

Our Return & Refund Policy explains the applicable return windows, eligibility requirements, return authorization process, return shipping charges, restocking fees, payment processing costs, inspection process, and refund timing.

For cancellations, returns, or refunds that are not caused by Cybovolt, applicable deductions may apply as described in the Return & Refund Policy. These may include a payment processing cost, return shipping charge, restocking fee, replacement packaging charge, or documented deductions for missing or damaged items.

For an approved return caused by a confirmed Cybovolt error, major shipping damage, or a covered product issue, the Return & Refund Policy explains the costs that Cybovolt will cover.

Do not ship a bike, battery, or component back without written authorization. Unauthorized shipments may be refused.

Eligible products are covered by the applicable Cybovolt Limited Warranty Policy. Coverage varies by component, product, and circumstances.

For a warranty or service request, we may reasonably request:

• Your order number and proof of purchase;
• The bike model and serial number;
• The current odometer reading;
• Photos, videos, app diagnostic information, or error messages;
• A description of the issue and when it occurred; and
• Reasonable troubleshooting steps or return of a replaced component.

Submitting materially false information, altered evidence, an altered serial number, an altered odometer, falsified records, or intentionally altered diagnostic information may result in denial of a claim to the extent permitted by applicable law.

Warranty coverage is not insurance. It does not cover ordinary wear, accidents, theft, misuse, unauthorized modifications, or other excluded circumstances described in the Warranty Policy.

Electric dirt bike classifications, registration requirements, licensing rules, age requirements, equipment requirements, speed limits, and permitted riding areas vary by product configuration and jurisdiction.

Some products or riding modes may be intended for off-road use only and may not be permitted on public roads, sidewalks, bicycle lanes, or public trails. A product's availability for purchase does not mean that it is legal to operate in every location or riding environment.

You are responsible for:

• Reviewing the product listing, Owner's Manual, and safety materials before use;
• Understanding the classification and permitted use of your specific product and configuration;
• Following applicable federal, state, and local laws;
• Obtaining any required registration, license, insurance, permission, or protective equipment; and
• Using the product only in lawful and appropriate riding environments.

Do not change speed settings, power settings, wiring, firmware, safety features, or other factory configurations in a manner that creates a safety risk or violates applicable law.

Your safety matters. Before riding, read the Owner's Manual and follow all safety instructions. Use appropriate protective equipment, including an appropriate helmet, and follow all applicable laws.

Before each ride, inspect the product and do not use it if a safety-related issue is suspected. Routine maintenance, inspection, and proper storage are the owner's responsibility.

Assembly, adjustment, repair, or installation work must be completed in accordance with the Owner's Manual. If you are unsure whether work can be completed safely, seek assistance from a qualified service professional.

Do not use the product for racing, stunts, commercial rental activity, overloading, or any use prohibited by the Owner's Manual or applicable law.

Using an electric bike or any product purchased from Cybovolt involves inherent risks. Riding an electric bike can result in accidents, serious injury, or death.

Before using any product, carefully read the Owner's Manual, safety instructions, warnings, and applicable product guidance. Use appropriate protective equipment, inspect the product before each ride, ride responsibly, and comply with all applicable laws.

To the maximum extent permitted by applicable law, Cybovolt is not responsible for accidents, injuries, death, losses, or damages arising from unsafe, improper, unlawful, or unauthorized use; rider error; failure to follow the Owner's Manual or safety guidance; third-party conduct; road, trail, weather, or environmental conditions; or other circumstances not attributable to a product defect, Cybovolt's negligence, or a breach of a non-waivable legal duty.

Lithium-ion batteries require careful handling. Follow the Owner's Manual and all battery safety instructions.

• Use only the charger supplied with the product or expressly recommended by Cybovolt;
• Charge the battery in an appropriate location and unplug the charger when charging is complete;
• Do not charge while sleeping or when no responsible person is present;
• Do not use, charge, or store a battery that shows unusual heat, swelling, odor, smoke, visible damage, or another potential safety concern;
• Do not open, tamper with, modify, or improperly dispose of a battery; and
• Contact Cybovolt support promptly if a battery safety concern arises.

Battery care, storage, warranty coverage, and excluded circumstances are described in the Owner's Manual and the Warranty Policy.

Certain products may include smart hardware, mobile-app features, GPS functionality, alarms, keyless access, navigation tools, cellular connectivity, or optional subscription services.

Some features may depend on third-party networks, wireless service, GPS reception, compatible mobile devices, app availability, operating-system versions, and subscription status. Availability, signal strength, and functionality may vary by location and circumstances.

GPS, alarm, notification, geofencing, and theft-deterrence features are designed to provide additional information and convenience. They do not guarantee prevention of theft, recovery of a stolen product, uninterrupted service, or emergency assistance.

Do not interact with an app, display, or mobile device while riding in a way that distracts you from safe operation.

Customer safety is important to us. If we issue a safety notice, product update, service campaign, or recall communication, please follow the instructions promptly.

We may contact customers using the contact information associated with an order or product registration. You are responsible for keeping your contact information current.

If a notice instructs you to stop using a product or component, stop using it and follow the stated instructions. Nothing in these Terms limits rights or remedies provided under applicable product-safety law.

You may use our website and online services only for lawful purposes. You must not:

• Use the website or services for fraud, unlawful conduct, or unauthorized resale activity;
• Submit false information or impersonate another person;
• Attempt to gain unauthorized access to accounts, systems, networks, or data;
• Transmit malware, harmful code, or disruptive content;
• Scrape, copy, reproduce, or exploit website content in violation of applicable law or our rights;
• Interfere with the security, performance, or proper operation of the website; or
• Use the website in a manner that violates another person's rights.

We may restrict or terminate access when reasonably necessary to protect customers, our systems, or our legal rights.

We welcome honest feedback. You may share a positive or negative review based on your genuine experience. Nothing in these Terms prohibits or penalizes an honest review.

When you voluntarily submit content to us for display through our website or an authorized Cybovolt channel, you retain ownership of your content. You grant Cybovolt a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and moderate that submitted content only as reasonably necessary to operate, promote, and improve our services.

You represent that content you submit is truthful to your experience, does not infringe another person's rights, and does not contain unlawful, abusive, deceptive, or privacy-violating material. We may moderate or remove content when reasonably necessary for those reasons.

This section does not transfer ownership of your review, prevent honest criticism, or authorize the creation or suppression of deceptive reviews.

Our website, trademarks, logos, product names, text, graphics, photos, videos, software, and other content are owned by Cybovolt or used with permission and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purposes. Except as permitted by applicable law or authorized by us in writing, you may not reproduce, distribute, modify, sell, license, or commercially exploit our content.

In the event of any concerns or complaints, especially a possible violation of intellectual-property rights, please email support@cybovolt.com.

Our website may include links to or integrations with third-party services, including payment providers, financing providers, shipping carriers, maps, mobile-device platforms, app stores, and other service providers.

Third-party services may be subject to separate terms and privacy practices. We are not responsible for a third party's independent acts, omissions, service interruptions, or policies, except to the extent responsibility cannot be excluded under applicable law.

Our collection and use of personal information are described in our Privacy Policy.

When you provide contact information, place an order, create an account, or request support, you agree that we may send transactional communications reasonably related to your order, account, product registration, safety notices, recalls, and customer-service requests.

Marketing communications are subject to applicable law and the preferences available through the relevant communication channel.

Except for any written product warranty expressly provided in the Warranty Policy, and to the maximum extent permitted by applicable law, our website and online services are provided on an "as available" basis.

We do not guarantee that the website, app, or third-party-dependent online features will always be uninterrupted, error-free, or compatible with every device or network.

This section does not disclaim any written product warranty, mandatory consumer right, or liability that cannot be disclaimed under applicable law.

To the maximum extent permitted by applicable law, Cybovolt will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website, online services, or third-party-dependent features.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any rights or remedies that may apply under mandatory consumer-protection or product-liability law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Cybovolt and its affiliates, officers, employees, and service providers from third-party claims arising from your unlawful misuse of the website, your material breach of these Terms, or your violation of another person's rights.

This section does not require you to indemnify Cybovolt for Cybovolt's own unlawful conduct, negligence, or obligations that cannot be shifted under applicable law.

Before filing a formal claim, we encourage you to contact us so that we can try to resolve the matter fairly and efficiently.

These Terms of Service and any separate agreements whereby we provide services to you shall be governed by and construed in accordance with the laws of England and Wales.

This choice of law does not deprive a consumer of any protection provided by mandatory laws that apply in the consumer's country, state, or jurisdiction of residence. Nothing in these Terms limits a consumer's right to exercise any non-waivable remedy available under applicable law, including any right to pursue an eligible matter in small claims court where applicable.

We may update these Terms from time to time. When we make a material change, we will post the revised Terms on this page and take any additional steps required by applicable law.

Changes apply prospectively from the time they become effective unless applicable law permits or requires otherwise.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary, without affecting the remaining provisions.

Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as permitted by applicable law.

These Terms, together with the policies and product-specific terms referenced in them, constitute the agreement between you and Cybovolt regarding the website, online services, and direct purchases from our website.
